How To File Bankruptcy | Chapter 7 Bankruptcy | Debt Relief

With the Holidays quickly approaching, some people are becoming mindful of the expenses related to purchasing gifts for loved ones. It is important to remember, especially for those in financial hardship, to spend responsibly over the holidays; and those who are considering filing Bankruptcy it is even more important to be aware that debt accrued over the holidays may not be dischargeable through Bankruptcy.

Bankruptcy is a complex area of law and involves many considerations, including whether to file, determining which type of Bankruptcy to file, the use of exemptions, understanding the protections of the Bankruptcy Code and using them to your advantage.

When researching options for debt relief; two common bankruptcy filings to consider are Chapter 7 and 13. Chapter 7 bankruptcy is personal debt relief for an individual which liquidates all of your debt. Chapter 13 bankruptcy is suited for those who have disposable income sufficient to repay debtors, and thus a payment plan is initiated directed by the bankruptcy courts.

In a Chapter 7 Bankruptcy, the entire process is usually completed within four months, and the debtor then receives a discharge of all dischargeable debts. This dischargeable debt includes credit card debt, old medical bills, utilities bills, unsecured loans, pay day loans, and most other types of unsecured debt. The advantage to filing Chapter 7 Bankruptcy is that your unsecured debt is completely eliminated, the process is fairly quick, and the automatic stay that takes place after filing prohibits creditors from making collection efforts.

It is important to be aware that while Chapter 7 Bankruptcy may ultimately relieve a debtor of the burden of insurmountable unsecured debt, it is a process that requires the production of several documents and tedious preparation. The more prepared the debtor is, the more seamless the process becomes.

Deer Vehicle Collsions

Each year, automobile and motorcycle accidents are a major cause of fatalities nationwide. As a result, it is important to employ all necessary safety measures available to avoid or reduce the risk of serious injury while operating an automobile or motorcycle.

An unforeseen cause of many accidents across the country is the unfortunate encounter vehicles have with large animals crossing the street. In Florida, there are many areas that include warning signs indicating where frequent deer crossings occur. These warning signs are particularly important for motorcyclists to be aware of, as collisions with large animals are even more devastating to motorcycle riders. It is important to know that at higher speeds it is very unlikely that motorists will have adequate time to prevent collision with a crossing animal.

If you encounter a potential collision with a deer or other large animal, it is important to brake firmly, flash your high beams at the animal in an effort to break their frozen response to the oncoming lights, and honk your horns to frighten the animal away.

If you or a loved one has been injured in a collision with a large animal and need help filing a serious injury claim, call Blick Law firm today at (813) 931-0840. Schedule a free 15 minute consultation with attorney Michael Blickensderfer. Think quick, call Blick!

Process of Purchasing a Home

A Real Estate Closing is the final step of the home purchase process, whereby the buyer and seller sign the papers to transfer the ownership of the home. In order to complete this final phase of the purchase process, it is important to understand the timeline of requirements that take place leading up to the Closing.

First, a buyer must open an escrow account with a neutral third party, whereby the buyer provides earnest money to be held in consideration of the purchase in order to demonstrate good-faith that the buyer fully intends on completing the sale.

Following the opening on an escrow account the buyer then needs to take the necessary steps to protect their interest in the home. These steps include:

  • Completing a Title search
  • Purchasing Title Insurance
  • Completing a Home inspection and Pest inspection
  • Negotiating the Closing costs; and
  • Locking the interest rate of the mortgage.

These steps are important in the completion of any Real Estate transaction, and many times it is important for the buyer to seek legal counsel prior to moving forward with the purchase process. An experienced real estate attorney can provide professional legal advice, and interpret the very complicated language involved in most Closing documents. The attorney is also capable of identifying potential problems with your purchase documentation, and can save you the hassle of dealing with unexpected complications that may arise during the Real Estate purchase process.

Possession of controlled substance

There are laws in place for many addictive drugs, known as “controlled substances”. Users of these drugs run the risk of facing difficulty with the law. Know the law, here are some things you should be aware of:

“Simple” Possession of Drugs means you actually have the drug in your possession or you have access to them, even if it is locked in your car.

“Trafficking” of Drugs generally means the distribution or selling of drugs. It also refers to growing or manufacturing with an intent to sell. Importing and exporting is also a form of trafficking.

Check foreign regulations when taking your own medication for personal use.

The laws also take into consideration where you have possession of drugs, and in particular, whether you are at or near somewhere where there are vulnerable people, such as a school or daycare. The seriousness of the possession charges increase in places like this. As innocent as it may seem, you may find yourself in a situation with a prescribed controlled substance in your possession.

Tampa- Banks incentive program to borrowers cause spike in short sale

Short sales are a lenders best friend! Only until recently, Lenders are starting to embrace the idea of Tampa bay short sales.

In the past three years, there has been a 350% increase in the amount of homes sold through short sale, according to Corelogic’s most recent numbers.

How are banks benefiting from this?

Banks benefit because it decreases the large amount of foreclosures, alleviating the court systems of back logs related to foreclose cases pending.

In a short sale, there is a seller & buyer.  The seller gets out of their home, often with a cash incentive to help with relocation expenses, and most banks do not hold a deficiency judgment against them.

The buyer gets a nice home at a very reasonable cost and  neighborhoods do not suffer from run down or vacant property.  Therefore, the bank is satisfied as well as cultivating economic stability and growth.  Everybody wins!
