Summer is here; 5 ways to get into gear- safety preacautions

Beaches, beer and barbecues! Summer is official. For most of us we migrate towards the beach on our days off or lounge by the pool before it gets too hot to walk outside. Right now is the perfect weather to be outdoors and soak up some sun!

At Blick Law firm, we strive to promote safety. Here are five ways to get into gear this summer so that you may enjoy this season – out of harms way!

1) Drinking. The summer calls for some great nighttime cook outs and hanging out in the back yard. If you are of age it is typical to drink during summer occasions and outings, so use common sense and precaution when planning your nights out. Make the safe choice not to drink and drive!  Have a designated driver planned or get a taxi service number and program it into your phone now before it is too late.

Blick works with Tampa Bay’s Cab Plus services. 813-288-888. Let them know Blick sent you to get the best service for a safe night on the town.

2) Bar hopping? Have a favorite bar you like to hang out at? Research and ask them how they will accommodate or assist you if you have had too much to drink.  You never know, until you ask.

3) Car pool it to the beach! Hanging out at Caddy’s or Shepard’s for the day… or just want a quiet get away? Check out the local bus routes and use that as your form of transportation. It is a safer method, it will help cut down traffic time and you are helping the environment. Win, win, win!

4) Road trip or mini vacation? A critical way to be a defensive driver is to get your car or bike inspected. Make sure you check your tires, brakes and windshield wipers. Be prepared for any amount of traveling and plan for all types of Florida weather conditions because you know it is unpredictable.

5) Theme parks = tourist hot spots. Parks this time of year may not only be overcrowded and hot, but incidents may likely occur. Make sure you are aware of safety guidelines and emergency units on location.

Take initiative for your family’s safety and research the parks protocol on inspections. Also, always choose a reuniting check point in order to prevent from losing your loved ones. And lastly, follow your gut. If it does not look safe, do not go on it.

Take these steps to plan a safe summer for you and your loved ones. If for whatever reason you find yourself in a state of emergency, call 911 first if injuries are severe. If you need further assistance or guidance call Blick Law Firm at 813-931-0840.

We are your local Tampa personal injury attorney here to help the hurting and any other legal needs you may have. Think quick, call Blick!

Attention all Motorcycle Riders! Is your ride endorsed?

If you wish to operate any two or three wheel motorcycle, whose engine is more than 50 cc, you are required to have a motorcycle endorsement on your driver license or a motorcycle-only license.

  • Why do I need to be endorsed?

THE 2009 FLORIDA STATUTES

Title XXIII – Motor Vehicles Chapter 322 – Drivers’ Licenses / 322.03  Drivers must be licensed; penalties.

(1)  Except as otherwise authorized in this chapter, a person may not drive any motor vehicle upon a highway in this state unless such person has a valid driver’s license issued under this chapter.

(a)  A person who drives a commercial motor vehicle may not receive a driver’s license unless and until he or she surrenders to the department all driver’s licenses in his or her possession issued to him or her by any other jurisdiction or makes an affidavit that he or she does not possess a driver’s license. Any such person who fails to surrender such licenses or who makes a false affidavit concerning such licenses commits a misdemeanor of the first degree, punishable as provided in s. 775.082 or s. 775.083.

(b)  All surrendered licenses may be returned by the department to the issuing jurisdiction together with information that the licensee is now licensed in a new jurisdiction or may be destroyed by the department, which shall notify the issuing jurisdiction of such destruction. A person may not have more than one valid driver’s license at any time.

(c)  Part-time residents of this state issued a license that is valid within this state only under paragraph (b) as that paragraph existed before November 1, 2009, may continue to hold such license until the next issuance of a Florida driver’s license or identification card. Licenses that are identified as “Valid in Florida Only” may not be issued or renewed effective November 1, 2009. This paragraph expires June 30, 2017.

  • How do I become endorsed?

It is simple.

1. All riders must have a regular Class E operator’s driver license.

2. Complete basic motorcycle safety course.

3. Go to a drivers license office or tax collector’s office that issues driver licenses and inform them that you completed the course to receive your endorsement.

4.  Cost: $7.00 endorsement fee, plus a license fee (see fees for original, renewals, duplicates, and replacement license), and $6.25 if applying at a county tax collector office.

The Department’s Florida Rider Training Program has a wealth of information on motorcycle safety and proper licensure. For more information, check out Florida Rider Training Program website. Also information on where to find approved sponsors who teach the course can be found here.

  • What happens if I do not become endorsed today?

**Please note that anyone driving a motorcycle without an endorsement is violating the law! You at the risk of being convicted for a criminal offense that is punishable with jail time. Don’t go into this alone, get a Tampa motorcycle attorney that can get you the best outcome possible in this situation. Think quick, call Blick!

Slow start for Florida’s foreclosure mediation program

Florida homeowners seeking relief under the state’s foreclosure mediation program were disappointed, according to new report, that says only a small percentage of mediations were successful. So far, the process doesn’t seem to have helped.

The first statewide report on the Supreme Court’s foreclosure mediation program is out, and at least one South Florida judge says the program is neither helping homeowners nor clearing caseloads.

About 4 percent of 57,909 foreclosure cases referred to mediation between March and November 2010 ended in agreement between the bank and borrower, according to the program evaluation, which included all 20 circuit courts.

The success rate is higher — 27 percent — if only mediations that actually occurred are considered.

The report, released on this week, was compiled by the Office of the State Courts Administrator.

Mediation was required by a 2009 state Supreme Court order as a way to lighten judicial caseloads, as well as aid borrowers — objectives Miami-Dade Circuit Judge Jennifer Bailey said have not been achieved.

“I think it’s fair to say the program has not met the case management goals we hoped to meet in terms of reducing the number of cases to be handled by the court, and, more importantly, it has not significantly helped Floridians stay in their houses,” said Bailey, who served as chairwoman of Florida’s Task Force on Residential Mortgage Foreclosure Cases. “It is incredibly disheartening.”

Florida requires that every foreclosure go through the courts, which had a backlog of 322,724 cases as of February.

Not All Fun & Games: Amusement Park Safety Tips

Florida is not only a vacation spot for beaches and cruises, but this sunny states’ main attraction lies in amusement parks. When you think back on your days vacationing, images at a park should more than likely recall happy times, full of fun. However, whether you are going to an amusement park for a fun-filled day or you work there, accidents that occur at an amusement park are both very serious or fatal.

Serious amusement park injuries include whiplash, neck and back injuries, heart attacks, broken bones and internal injuries. If  you recently have been injured at an amusement park from visiting the park or are employeed there, you may be eligible to file a claim and receive compensation for your pain and suffering.

The facts

According to the International Association of Amusement Parks and Attractions (IAAPA), approximately 1,343 ride-related injuries occured within the United States in 2008.

Who is responsible if you are found injured?

Accidents occur at all types of amusement parks. From a carnival-type  to well-known theme parks, accidents are bound to happen.

The amusement park owners have legal responsibility to ensure safety for all those that visit their park. Parks ensure the property and the attractions on them. Attractions are to be regularly maintained and kept in proper safety conditions.

If an injury occurs on the amusement park property or attraction and the injury could have been prevented through reasonable steps, the injured person may be eligible to sue for compensation from sudden loss or injury.

Know your rights

Depending on the circumstances of the accident, harm upon visitors or employees may rest on the responsibility of the amusement park owner. An experienced attorney can help evaluate the statute of limitations in your circumstance and make sure you receive proper legal guidance and compensation for your injury.
