Balancing Life & The Workplace: Due to trends with the ailing economy, quotas, the extremely competitive market, many law firms are pushing out work at an extraordinary rate in order to stick out from the crowd. However, due to this focus on committing as much time as possible to the workplace, many employees have had to sacrifice their personal lives in order to succeed in their business. However, many employees are pushing strongly for a new balance in the system, including flexible hours and part-time employment options for certain times of the year.
  4. Mobile Technology: The trends of growing mobile markets and increasing expansive use of legal apps and services through the market has caused an influx of newcomers to the mobile space. Many law firms are now attempting to enter the marketplace with their own legal apps, and by doing so increasing their overall presence and exposure.

Overall, many of the new trends that are being seen in this day in age is due to the new generations of lawyers, paralegals, and other legal employees who are continuously bringing a new dynamic to the saturated marketplace. Since this generation understands how to appeal to it’s own market, they bring new ideas forth and push for expansion in different areas. Legal News | Obama Affordable Care Act

For the second time in three years, the Obama administration’s Affordable Care Act is once again in the hands of the Supreme Court to interpret the legislation. The issue at hand is King v. Burwell, and is to decide whether or not low and moderate income Americans living in specific states should be allowed to receive tax subsidies in order to purchase health care insurance. What the side in favor of taking action is stating is that a straight reading of the legislation’s text means that the law states that credits are available only for those who buy insurance in marketplaces or exchanges which are established by the state.

If the court agrees with this statement, millions in 34 different states that didn’t set up their own exchanges would lose federal subsidies. This essentially means that the entire law would be undermined. President Obama recently held a press conference in which he stated that the Supreme Court should not have even considered the latest challenge to his signature healthcare law, however he believes that justices will “play is straight” and allow the law to remain intact.

Recent pollings show bipartisan support for both sides of the case, however a majority polled that they did not want the Supreme Court to take action. The public’s opinions on the matter, however, is not always within the court’s jurisdiction. Their job is to interpret the law to the best of their abilities, and that means they make very difficult decisions which impact a majority of Americans.

While this case is of great urgency to many, the court’s decision still has not been made public. Their decision on the matter is expected to come out within the following days, and will have a significant impact on the Obama Administration moving forward.

Safety Summer Tips

The summer is a fun care free time for many, but it’s easy to get carried away with the summer lifestyle. We here at Blick Law Firm have some tips and advice to share in regards to summer safety to help you and your family remain safe during the summer. While it is important to have a good time, we encourage all of you to remember safety is a priority.

General Tips
1. Be careful around fireworks. While they are fun, simple fireworks such as sparklers can reach temperatures of up to 1000 degrees Fahrenheit. Always keep an eye out for any children playing with fireworks.
2. Use insect repellents containing DEET when outside in order to prevent insect-related diseases.
3. Make sure that you and your children wear helmets when bicycling, rollerblading or skateboarding in order to properly prevent head injuries.
4. Remember never to leave children or pets in hot cars. In just 60 minutes, your vehicle can reach temperatures 40 degrees higher than the outside temperature.
5. When children are walking to and from the areas in the neighborhood, ensure they utilize the buddy system and have a cell phone in case of an emergency.
6. Avoid sun exposure during peak sun hours (10 AM – 6 PM).
7. Every family should have at least one first aid kit at home which is well stocked and readily accessible in case of emergencies.
8. Remember to ensure that children have proper adult supervision for any beach or pool activities.

The Summer can be full of dangers, and it’s imperative to always practice keeping you and your children safe, whether from insects, sunburn, or strangers. Possession of Marijuana

Possessing cannabis within the state of Florida is illegal. This is a common and well known law, yet, what exactly happens when you are arrested for possession of marijuana? There are several things that can, may, and perhaps will happen after you are charged with possession, and several punishments that you may face.

First of all, it matters how much marijuana you have on you at the time of your arrest. This is what makes the difference between a misdemeanor and a felony. If you possess under 20 grams, you will be charged with a misdemeanor; if it is over 20 grams, you will be charged with a third degree felony. However, in the legal systems, you are innocent until proven guilty.

There are several defensive approaches to take when charged with possession of marijuana, but some of the more common ones are:

illegal search and seizure,
constructive possession,
medical necessity,
lack of knowledge,
overdose defense, and
temporary possession

Many of these defenses have the ability to protect you from being charged with possession when you truly are not guilty. For example, it is possible that the law enforcement officer may have exceeded his available power, and either required you to or coerced you to submit to a home, body, or vehicle search, which is an illegal search and seizure. Or, if you were driving someone else’s car and were found with weed in the glove compartment, you can defend using constructive possession and state you cannot be charged for something you didn’t even know was there.

However, if the charge does stick, there are several punishments that you can be assigned depending on the severity of the crime. For the felony charge, a judge can sentence up to five years of probation, five years in prison, a fine up to $5000 dollars or any combination of the three. For a misdemeanor possession charge, you may face up to a fine of $1000 dollars, one year of probation, one year in jail, or any combination of the three. Also, in the case where you are convicted of possession of marijuana in the state of Florida, your driver’s license or privilege to drive will be revoked by the Florida DHSMV for one year.

Cuban Immigration

CUBAN-IMMIGRATION, BLICK-LAW-FIRM, TAMPA-IMMIGRATION-ATTORNEYImmigration. It has been a long, highly debated and highly controversial topic between many Americans throughout the years. Some believe that we should accept anyone who wishes to enter our borders and become a citizen. Some say we should deny them. Others say we should just allow children. Throughout the years, it seems we still don’t fully understand where we stand, but many parents, children, and families are constantly being affected by our laws and handling of immigration law. And with the United States taking steps for the first time in fifty years to normalize relations with Cuba, some people believe it may be time to re-examine our outdated methods.

Due to our normalization of relations with Cuba, it will become much simpler for Americans to travel to Cuba and vice-versa. That will make the wet-foot, dry-foot policy which we currently have in place not really needed, according to several politicians. While the current administration currently states that the policy will remain, Cuban officials are calling for a stopping of the policy in order to stop the United States from draining skilled workers and citizens from Cuba. Thanks to the fear that the policy may change, we are finding a growing number of refugees attempting to reach the United States before the removal of the policy happens.

People are still as torn as ever on the policy, and there doesn’t seem to be a clear cut solution to the issue. However, as people continue to debate this issue, more and more Cuban immigrants are migrating to the United States, whether to escape economic persecution or political persecution, and families are being split apart by the current legal laws.
