Attorney Michael Blickensderfer Opens his Wallet to Help Out in Tampa

Lawyers Giving Back looks at a side of lawyers you don’t hear too much about—the side that gives back…pays it forward..and shares the love. We’ve found quite a number of attorneys who log non-billable hours helping others—simply because they believe it’s the right thing to do. Their stories are inspiring, and hey, who knew lawyers were so…good? If you’ve got a story to share about an attorney who’s doing the right thing, let us know—we’d love to let others know, too. Today, we’re talking with Florida attorney Michael Blickensderfer

Attorney Michael Blickensderfer: “You think they are small or unimportant donations, and you don’t realize the impact that will have on others.”

A quiet spoken attorney with a very loud and clear commitment to the community around him, Michael Blickensderfer made a decision to open his wallet and open it wide. Although the Blick Law Firm may do a bit of legal work for free from time to time in the classic pro bono definition, Blickensderfer, a former prosecutor and public defender in New York and Florida, decided he’d step to the plate with cold, hard cash. Attorney Blickensderfer Attorney Michael Blickensderfer Opens his Wallet to Help Out in Tampa

The firm contributes up to 10 percent of its annual income to charity. “It varies,” says the very modest Blickensderfer, “a tithe is 10 percent, we are not always faithful to that amount, but we try to be consistent.”

After 25 years in public service and a brief turn at private practice in three other Florida firms, Blickensderfer went out on his on own two years ago. Together with his wife as the office administrator and his daughter as the marketing and community liaison, the Blickensderfers have established their own very personal way doing things.

The Blick Law Firm has established relationships with about a dozen organizations, from the St. Jude’s Hospital for Children to a Christian motorcycle riders association to a suicide prevention organization. “These are groups we have connected with sometimes out of personal relationships with some of their members, sometimes people come to us or perhaps it is through a client,” says Blickensderfer. “We discuss as a family where we can best put our resources and make a difference.”

Primarily a personal injury practice, Blickensderfer provides a range of other legal services from bankruptcy law to real estate. They regularly reach out to organizations and participate in community events. “Sometimes we hear about a needy family through some of these organizations,” says Blickensderfer, who is a committed Christian. “It touches your heart, you feel compassion and just you feel the need to reach out and help.”

“On New Year’s day we went to the Christian Motorcycle Riders Association event,” says Blickensderfer. “We just showed up and gave them a donation. We didn’t think we did that much but they were so grateful.”

“We were just putting a little gas in their tanks; they really go out and do all the hard work. They’re out there with their ‘tanks on fire’ ready to do things and we were pleased to able to help them,” Blickensderfer says.

Although Blickensderfer, who is also a former US Marine, says there are a lot of lawyers out there who volunteer their time he prefers to go the ‘donation’ route. “A lot of lawyers at other firms do a lot of pro bono work,” he adds. “I don’t do that much in the classical sense of pro bono.”

The firm is developing a bit of a reputation around Tampa for its generosity but Blickensderfer says people still seem surprised to see him arrive with a check in hand. “We just want to help the best way we can,” he says. “I think people are surprised in this day and age when anyone goes out of their way to help.”

“You think they are small or unimportant donations, and you don’t realize the impact that will have on others,” he adds.

“I wish we could do more,” says Blickensderfer. “We have a lot to be thankful for and I count my blessings when I look at others and see how many people are in need.”

“I thought I had problems,” says Blickensderfer with a smile and a bit of humor in his voice.

Lucky for Tampa Bay, Blickensderfer came to town with his check book.

Michael Blickensderfer has a degree in business administration from Ohio State University and earned his J.D. at the Seton Hall University School of Law in New Jersey. The Blick Law Firm, based in Tampa, FL, handles personal injury litigation, bankruptcy law, wrongful death lawsuits, medical malpractice cases, as well as other areas of law.

The Fuel that Drives a Law Family

For Blick Law Firm, Hard Work, Outreach and Faith make it Work

By DONNA BALANCIA, TFLJ Editor

TAMPA — Mike Blickensderfer, president of Blick Law Firm, measures the success of his business by a unique standard: His family wants to work there too.

“My wife and each of my children have different talents, and I’m fortunate because they are putting them to use at our law firm,” said Blickensderfer, whose Tampa firm is well-known in motorcycle circles and in community groups on the West Coast.

Mike’s wife, Vivian, is the marketing manager of Blick Law Firm, Dana Blickensderfer, 22, is the public relations and social media director, and son Steven looks to be joining his father as an attorney at the firm after his graduation from University of Florida Levin College of Law in May.

“It’s such a blessing to see our each of our children use their talents to help out the business,” said Vivian Blickensderfer. “They wanted to do it.”

Eldest daughter, Danielle — now studying architecture in New York — was the first one to work at the firm, and then handed the reins to sister, Dana.

“Danielle was the one who started it all for me and my brother,” said Dana Blickensderfer. “She was looking for something to do while going to school and she was the gatekeeper of the firm.”

Blick Law Firm holds seminars hosted by Vivian, sponsors events put on by Dana, and works with groups of realtors, doctors and other attorneys to generate the business.

While family comprises the nucleus of the team, the 13 non-family employees play a vital role to running a diverse practice.

The Blick Law Firm has been nominated by The Tampa Business Journal as one of the top places to work in Tampa Bay.

“Our faith is about  helping one another in the community,”  Dana Blickensderfer said. “The foundation of our business is helping the hurting.”

Compassion is critical in a business that deals with family law issues.

“Unfortunately, some cases involve death and we help the family cope,”   Dana Blickensderfer said. “Mike is really good at listening and supporting the family.  But he’s also very good at taking care of the legal stuff that they can’t do on their own.”

Compassion — and understanding — also play a strong role inside the office.

“We keep our morale high by having little giveaways every month, spending time with each other, and keeping communication lines open,” Dana Blickensderfer said.

Mike Blickensderfer said the practice has evolved over the years.

“We were initially focused on the motorcycle community but now we’re focused on the whole community,” he said. “Our motto is ‘Helping the hurting,’ and we are focused on family issues.  We hold events, and we’re getting new clients, many in bankruptcy and in foreclosure.”

Mike Blickensderfer didn’t come up the easy way.  He spent time in the Marine Corps and worked with the Teamsters in New York. Much of what he learned about law, he taught himself.

“I’ve been practicing over 20 years and I would say I’m self-taught through life experiences,” he said.

But during his life there has rarely been such satisfaction as what he feels having his family around.

“We love the chemistry our children bring into the practice,” he said.

Vivian Blickensderfer, who met Mike during the Teamster days at New York’s LaGuardia Airport where they were both employed, said when you own your own practice, you have to make some sacrifices.

“When you’re a small company like us and you don’t have the budget for a billboard, your marketing has to be at the grass roots level,” she said. “You’re getting directly with the people, going to seminars, we’re vendors at events, wherever we can be out in front of the people, we’re there.”

But while Blick Law Firm may not have conventional wealth, Mike Blickensderfer said the firm is teeming with riches.

“When you have your own business you do pay a price,” he said. “But it’s also very rewarding. We love the chemistry our family brings.”

St Patrick’s Day Safety 2013

With St. Patty’s Day approaching, many people are planning their festivities for the weekend and the excitement to celebrate with friends and family is beginning. However, every St. Patty’s Day people tend to get carried away in their celebrations and face the risk of being arrested for a variety of alcohol related offenses. Due to an increased tendency to behave irresponsibly during this festive time, arrests for DUI especially tend to increase. It is important to remember to always be responsible during and after St. Patty’s Day celebrations, and also to be aware of the potential consequences that can arise in the event that you are arrested and charged with DUI.

Florida drivers arrested and charged with DUI face obvious and hidden consequences that can have a wide reaching personal impact. When a person is charged with a DUI, the consequences may include:

  • License Suspension
  • Drastic Insurance Increases; especially when required to obtain FR-44 insurance coverage
  • Complications with Employment; both present and future
  • Driving Restrictions that require additional costs such as an Interlock Device installed in your vehicle for a period of 6 months, 1 year, or even 2 years, depending on your situation
  • Probation
  • Legal Fees and Court Costs

These consequences contribute to a multitude of difficulties that one faces when battling a DUI charge. It is important to fully understand and appreciate the severity of possible consequences associated with DUI, and always take all possible steps to avoid Driving Under the Influence.

DUI, or Driving Under the Influence, generally refers to a person who has physical control of a vehicle while that person’s normal faculties are impaired by any type of drug, including alcohol, illicit drugs, and even prescription medication. Therefore, if you are under the influence of drugs other than alcohol and are in actual physical control of a vehicle, you can still potentially be charged with a DUI.

In Florida, a blood alcohol level of .08 or more constitutes alcohol impairment beyond the legal limit. However, a police officer may still arrest you for a lower blood alcohol concentration (BAC) if they suspect that your normal faculties are impaired while operating a motor vehicle. Having a BAC under a .08 will increase your chances of overcoming the DUI conviction, but you may still be arrested and endure several hassles that go along with combating a DUI charge.

If you are charged with DUI, it is important to seek legal counsel immediately! Call Blick Law Firm today at 813-931-0840. Make an appointment for a free 15 minute consultation with attorney Michael Blickensderfer to determine what your options are moving forward.

Tampa Short Sales

Homeowners are often unsure of what options are available when they reach financial hardship. A short sale is an agreement by a mortgage lender to sell property for an amount lower than the balance owed in order to relieve the buyer of the mortgage obligation.

A short sale can be a helpful tool when trying to avoid foreclosure. Depending on the negotiated amount of the sale and the timeliness of past mortgage payments, a short sale may help avoid the huge hit to your credit score that foreclosure causes. Additionally, short sale participants can later purchase a home in a shorter time than those who foreclose on their property.

From an economic perspective, Short sales are simply a more beneficial option than Foreclosure. Lenders have less to lose, homeowners incur less damage to their credit, and the surrounding community is less likely to be affected by the decline in value that follows abandoned properties forced into foreclosure at greatly diminished costs.

A short sale can be completed by finding a buyer to purchase the home who is willing to pay current market value, and having the mortgage provider agree to the sale. Any shortage after the sale will then either be written off by the lender and an IRS 1099 is issued to the seller, or a deficiency remains which the lender may pursue to collect against the seller.

The short sale process can be complicated, and the lender may not be willing to negotiate. It is important to know that a real estate attorney can help negotiate the sale and terms with the mortgage lender and provide you peace of mind that your sale is being handled by an accountable professional.

If you have legal questions regarding your short sale or you are considering your options, call Blick Law Firm today at (813) 931-0840 to schedule a free 15-minute consultation with attorney Michael Blickensderfer.
